Is there discrimination if a municipality ignores the wishes of 70% of the citizens?

Since for some time there have been certain people on Sun and Holidays, their hedges

began to shear, and to cut grass, and let the church die

I have a petition against noise nuisance on Sundays and Holidays on which 70%

agreed with me that those certain days the Sunday rest should be respected,Brt2 Did zelde Inquiry with the same result,70%

Is there then no question of decrmination according to the law of 25 February 2003?

Belgian Official Gazette March 17, 2003, or may a Municipality ignore its citizens? Isn’t this a form of dictatorship?

People are disgusted by such a behavior.

Thank you very much for your reply

Answer

Dear Jos,

There is no discrimination. No matter how deplorable your situation and that of that 70%, you stand no chance of being accepted by a court in your reasoning. At least not on the basis of the discrimination law. You do have a chance in court if you can specifically point out the damage you have suffered.

I would give you threefold advice:

– contact the ombudsman service of your municipality;

– speak to a local politician;

– vote for a party currently in opposition in the next municipal elections; You can possibly invoke this – certainly if you are with many – as a means of pressure when addressing a local politician, which I have just suggested. In other words: threaten, with the petition in hand, to vote for another party from now on. They are sensitive to that.
