As a result of a German court ruling, OPPO and OnePlus phones are no longer allowed to be sold in Germany. Both brands have violated Nokia patents. There is now also a sales ban for other smartphone manufacturers.
OPPO and OnePlus banned in Germany
OnePlus and OPPO have infringed Nokia’s patents for 4G and 5G technology, a regional court in Germany ruled. As a result, OPPO and OnePlus phones are no longer allowed to be sold in Germany, but the parties are expected to reach an agreement before that happens. Meanwhile, Finnish Nokia is suing more companies that fall under the same BBK holding as OPPO and OnePlus, reports Win futureand those are Vivo and Realme.
BBK Electronics would have to pay 2.50 euros per smartphone sold to be able to use Nokia’s 5G license. There is a big problem, because according to German law, OPPO, OnePlus, Vivo and Realme should conclude a worldwide license agreement with Nokia.
In Germany, the market share of the BBK brands is over 20 percent. Of the approximately 200 million smartphones sold by OPPO worldwide, only two million (1 percent) end up on the German market. If they want to remain active on the German market, BBK will have to pay millions of euros in license costs. Those costs then have to be settled in one way or another and the consumer usually bears the brunt of this.
Lawsuits in Western Europe
Meanwhile, Nokia is fighting lawsuits in several countries. These are France, Spain, Finland, Sweden, the Netherlands and Great Britain. According to Winfuture, the brands OPPO, OnePlus, Vivo and Realme threaten to disappear completely from the Western European market, if Nokia is found in the right. For devices that have already been sold, BBK states that the “products can still be used without restrictions”.
Often, after a sales ban, an agreement is reached between the parties. If they cannot work it out together, the telephones sometimes disappear from the market for a long time. Some manufacturers have almost completely disappeared from the global smartphone market due to the revocation of licenses.
