I would like to know if the previous accountant has the right to confiscate my existing accounts. As a result, no filing could take place and I cannot declare the year 2008 to the tax authorities. I know I have to pay my outstanding balance. I want that too, but even his lawyer won’t answer a registered letter.

As an accountant/bookkeeper, the right of retention is deontologically prohibited. The best thing you can do is ask your new accountant to send a letter to the previous accountant requesting your file. He can also specify what must be included in the file. The fact that you have not yet paid your invoices cannot be regarded as a reason for not delivering your accounts.
