Insulting your boss in WhatsApp group
If you start rudely insulting colleagues in a closed WhatsApp group (with racist, sexist and inciting comments), you can be fired with immediate effect.
It seems that you can only rely on the confidentiality of such a WhatsApp group in exceptional cases. So think before you leap and always think carefully before sharing messages with your colleagues!
Strong insults and threats of violence
Insulting colleagues in a WhatsApp group of befriended employees of TUIfly in Hanover-Langenhagen recently led to immediate dismissal. One of the members shared a Word document in the group, which eventually ended up with the works council.
The document contained racist, sexist and grossly offensive statements such as “our pilots should all be gassed” and “I long for the day this place catches fire”. This insult in a closed WhatsApp group led to instant dismissal.
Private WhatsApp group is not necessarily private
The person concerned went to court, initially successfully. The regional labor court stated that those involved could assume that their statements in the WhatsApp group were confidential. That would mean that they can say anything there without any problem.
However, the Federal Labor Court disagreed, stating that it depends on the content of the messages, as well as the size and composition of the WhatsApp group. In the event of serious insult to employees in a WhatsApp group, disclosure is to be expected, according to the federal labor court.
