Tesla prices stated in violation of the Dutch Advertising Code

Tesla lists prices for new cars on its website in a way that is contrary to the Dutch Advertising Code. The Advertising Code Committee ruled this out after a complaint from a Tesla buyer.

Usually the new prices that you see on the website of a car brand on the model page are ready-to-drive prices, but not with Tesla, Tesla has prices there that are not yet complete. These are tax prices, because it appears that there will be additional costs if you then want to order a Tesla. For example, for a Model Y, the first listed price of €44,990 increases to €45,993 due to destination and documentation costs and the recycling contribution. That price only appears when you click through to ‘cash’ under the financing options.

A Tesla Model Y buyer submitted this state of affairs to the Advertising Code Foundation and the Advertising Code Committee looked into it. AutoWeek received the ruling from the buyer in question. It turns out: the way in which Tesla displays prices is contrary to the Dutch Advertising Code. To be precise with Article 2, namely: “Advertising must be in accordance with the law, truth, good taste and decency.” The following RCC also conflicts with Article 8.4, rule i, which, in short, states that when an invitation to purchase is invited, the unavoidable costs must be included in a total price.

For the time being, the ruling has no consequences for Tesla. The Advertising Code Committee does state: “The Committee recommends that advertisers no longer advertise in such a manner.” There is still time to appeal until Friday 5 January. Tesla was asked for a response by AutoWeek, but the company did not want to comment.
