Dozens of traffic fines have been withdrawn by the Public Prosecution Service after Verkeersboete.nl objected on behalf of the fine recipients. Agents would not have stopped the people in question due to the corona measures, while they could.
At the end of last year there was a situation that is reminiscent of what is happening now. Then a traffic fine was declared invalid because someone had been fined by an invigilator on registration for a speeding violation, which normally involves a stop. Even then, due to the corona measures, especially keeping one and a half meters away, the officers failed to fine the offender personally. Although there was an official work instruction for the officers to avoid contact as much as possible and to write out fines preferably by registration number, the subdistrict court in Amsterdam ruled in favor of the person fined.
Now something similar is happening with dozens of people who were fined without being stopped. The Public Prosecution Service is withdrawing these fines, according to Verkeersboete.nl for fear of the decision of the court in Leeuwarden: “Recently, the court in Leeuwarden determined in such a case that the agent should indeed comply with the corona rules – such as the 1,5- meter measure – could have stopped the alleged traffic offender. The fine was quashed by the court. The Public Prosecution Service is now choosing eggs for its money in the cases that Verkeersboete.nl had filed. The fines of dozens of cases that were filed on Tuesday 21 December would serve the court in Leeuwarden, have been withdrawn by the Public Prosecution Service.”
