The company behind the parking app Parking Alarm has appealed against the ban on this app in Amsterdam. The company has filed for an urgent appeal at the court in the capital.
In summary proceedings brought by the municipality of Amsterdam, the preliminary relief judge banned the use of Parking Alarm Clock in Amsterdam a month ago. According to the ruling, Parking Alarm encourages ‘unlawful behavior’, such as not paying the parking costs due. Parking alarm uses dash cams that are linked to a platform that reads video images. Anyone who receives a message from the app that a scan car is driving through the street has five minutes to pay the parking costs and avoid a fine. The start-up charges € 1.49 for each warning message received.
If the court approves the urgent appeal, there could be a new ruling in April. If the procedure is not treated as an urgent appeal but as an ordinary appeal, the expectation is that the court will give a ruling in September. The municipalities of Rotterdam, Utrecht and Leiden have also announced steps against parking alarm if it does not cease its activities in those cities. Founder Luis Roman says he will respond to this for the time being, until there is a judgment in the appeal in Amsterdam. In this way he hopes to “prevent multiple lawsuits”.
