Brazil recalls iPhone from the store – will the Netherlands follow?

In Brazil, the iPhone is recalled from the store because Apple does not comply with the law. But where is the problem then? And could that also happen in the Netherlands?

Brazilian government: chargers must be boxed

In September, the Brazilian government required Apple to include a charger in the box of all iPhones. However, Apple still does not comply with this requirement, which is why the Brazilian government has now recalled iPhones without a charger from stores.

This decision follows after Apple has already received several fines of millions of euros for omitting the charger in the iPhone boxes. Apple does not seem to want to give in to the new legislation and has challenged the decision in court.

Apple has stopped including a charger in the box for free since the iPhone 12. The iPhone 11 is now also equipped with a new, more compact box, which no longer contains a charger.

The reason for omitting the charger is durability, according to Apple. By not giving a charging cable with every new device, the environment is spared, according to the company. There is undoubtedly also a financial motive behind this: without a charging cable, the device simply costs less money to produce.

Lawsuit must resolve

Apple has therefore challenged this new legislation in court, the company believes that you as a buyer are well enough informed about the contents of the iPhone box. The judge allowed Apple to continue selling the iPhones until a ruling is made on the case.

So the question now is whether the Brazilian government is not acting outside its right by removing the iPhones from the shops and banning their sale. Remarkable in any case: the new Apple TV 4K is sold worldwide without a charger for the Siri Remote (with USB-C), but in Brazil there is a charger in the box. Apple seems to want to avoid more confrontations in any case.

What does the Dutch government think?

In the Netherlands there is no law that determines whether a charger must be included in the iPhone box. The most important new legislation in the Netherlands and other European countries is the introduction of the USB-C port for all new electronic products from November 2024. Apple seems to be complying with this next year with the iPhone 15.

So we don’t have to worry that the iPhone – just like in Brazil – will also be removed from the store. However, the question remains for how long the iPhones will be delivered to the stores, given the current production problems that Apple is facing.
